Mellanie Party Design agreement

 

Customer is responsible for the complete range of rental equipment damages including, loss, tears, cuts, burns, etc.

Rental does not include set up or take down of equipment, A pre-determined fee or $20.00 per hour for each person will be assessed on the contract for the MELLANIE PARTY DESIGN crew for work involving moving the rented equipment back to the original point of delivery.

Daily rates always apply for the first 24 hours the items are out unless otherwise specified. Long term rates apply only if paid for in advance and displayed on contract. Any changes or cancelations must be within 48 hours prior to delivery. 

NO REFUNDS.  

PAYMENT TERMS:  10 DAYS PRIOR TO EVENT DATE 

                                     C.O.D. FOR ANY ITEMS ORDERED FOR IMMEDIATE DELIVERY.

EQUIPMENT RECEIVED IS SUBJECT TO THE TERMS AND CONDITIONS ON THIS AGREEMENT AS WELL AS THE OFFICIAL INVOICE WHICH TOGETHER CONSTITUTE THE FULL CONTRACT.  

 

Any claim against complete payment due to errors on behalf of MELLANIE PARTY DESIGN, such as delivering damaged or wrong/ unordered equipment must be made at the time of delivery. Customer is encouraged to inspect the equipment thoroughly at delivery, if there are errors, claims must be noted immediately.  

Customer accepts the equipment ‘’AS IS ‘’ and will save and hold MELLANIE PARTY DESIGN harmless from any and all damages or injuries sustained by any person or entity while the equipment is in possession or control of customer. 

Customer acknowledges that he/she has inspected the equipment prior to the time of taking possession thereof, and has found it in good conditions and repair, or will inspect it immediately on taking possession, and will inform MELLANIE PARTY DESIGN if not in good condition or repair.  

There are no warranties which extend beyond the description on the face of this document. Customer shall be fully responsible for all rental charges and other charges hereunder, even if customer directs that all or any portion of said charges be billed to another person or entity. Customer agrees to operate the equipment only in the manner for which it is intended, and not to attempt to make any repairs to the equipment, but shall return the equipment to MELLANIE PARTY DESIGN promptly and will cooperate with MELLANIE PARTY DESIGN in making the equipment available for pick up by MELLANIE PARTY DESIGN, customer shall pay MELLANIE PARTY DESIGN upon demand for all equipment lost or damaged. Customer acknowledge having read the foregoing terms and conditions and agrees to be bound thereby and further agrees to pay the purchase/rental price as set forth on foregoing document. In the event that MELLANIE PARTY DESIGN incurs any expenses, including attorney’s fees to enforce this agreement the same shall be paid by purchaser/Licensee.   

The terms of the agreement on this agreement are incorporated herein and I acknowledge having read the same and received a copy of thereof. All others are final and must be paid in full. Any claim against complete payment due to errors on behalf of MELLANIE PARTY DESIGN, such as delivering damaged or wrong/unordered equipment must be made at the time of delivery. Upon inspection, customer will sign for receipt of equipment, after which time, no claims are allowed.  

Once the product/materials have been decided upon, a 30% NON REFUNDBLE ADVANCED PAYMENT WILL BE REQUIRED AT THE TIME OF CONTRACT AGREEMENT. 

Additionally, a secondary deposit will be assessed on the order which is wholly dependant on the types of products/materials ordered. Therefore this deposit can vary in dollar value depending on what products are ordered. The purpose of this supplementary deposit is to ensure that all products released from our facilities are returned in full and in the exact condition it was pick up or delivered. This deposit will be refunded after all the products/materials have been inspected by MELLANIE PARTY DESIGN.
