Customer is responsible for the cost of replacement or any linen returned torn, burned, or cut.

Customer will be charged for lost or damaged cartons.

Rental fee DOES NOT include setup or take down, on table cloth, napkins, skirt, overlay & other only on chair cover & decoration.

DAILY RATES always apply for each 24 hours the items are out unless otherwise specified. Long term rates always apply ONLY if paid for in advanced and are shown on contract. Any changes or cancellations must be made 48 hours prior to delivery. NO REFUNDS, NET CASH ON DELIVERY.

EQUIPMENT RECEIVED IS SUBJECT TO CONDITIONS AND TERMS ON THE FRONT AND REVERSE SIDE OF THIS CONTRACT.

CUSTOMER IS RESPONSIBLE FOR BREAKIG AND/OR LOSS

AGREEMENT: LICENSEE - TAKE NOTICE.

MELLANIE PARTY DESIGN INC as Seller/Licenser and the Purchase/Licensee identified on the above hereof, herby agree and acknowledge as follow:

MELLANIE PARTY DESIGN INC uses great care to maintain all of its equipment in good order and repair. However, MELLANIE PARTY DESIGN INC gives no warranty expressed or implied of merchantability or fitness as to condition, quality or as to any other matter, of any equipment which is sold or use of which is licensed. MELLANIE PARTY DESIGN INC shall not be responsible for damages or personal injuries which occur while the equipment is in Purchase/Licensee's possession since MELLANIE PARTY DESIGN INC has no control over how Purchaser/Licensee will maintain or use the equipment. Purchaser/Licensee acknowledges that he has inspected the equipment prior to the times of taking possession thereof, and has found it in good condition and repair, or will inspect it immediately on taking possession, and will inform MELLANIE PARTY DESIGN INC if it is not in good condition or repair.

Purchaser/Licensee accepts the equipment "as is", and will save and hold MELLANIE PARTY DESIGN INC harmless from any and all damages or injuries sustained by any person or entity while the equipment is in possession or control of Purchaser/Licensee. There are no warranties which extend beyond the description on the face of this document. Licensee shall be fully responsible for all rental charges and other charges hereunder, even if Licensee directs that all or any portion of said charges be billed to another person or entity. Licensee agrees to operate the equipment only in the manner for which it is intended, and not to attempt to make any repairs to the equipment, but shall return the equipment to MELLANIE PARTY DESIGN INC promptly and will cooperate with MELLANIE PARTY DESIGN INC in making the equipment available for pickup by MELLANIE PARTY DESIGN, Licensee shall pay MELLANIE PARTY DESIGN INC upon demand for all equipment last or damaged. Purchaser/Licensee acknowledges laving read the foregoing terms and conditions and agrees to be bound thereby and further agrees to pay the purchase/rental price as set forth on the foregoing document. In the event that MELLANIE PARTY DESIGN INC incurs any expenses, including attorney's fees to enforce this Agreement the same shall be paid by Purchaser/Licensee.
